National Energy Rebate Fund

The Office of the Colorado Attorney General filed a lawsuit against the National Energy Rebate Fund (NERF), a Grand Junction company, in February 2009. The Court entered Default Judgment in early 2010 against Defendants NERF and Tim Stubbs, having determined that defendants knowingly violated the Colorado Consumer Protection Act, misled consumers that the rebate program was being administered by a third-party, misrepresented the ease of receiving a rebate, and misrepresented the purpose of the NERF program as an effort to promote the purchase of energy efficient products. This default judgment granted the Attorney General's office access to the $4.4 million that NERF held in escrow for these rebates. This amount equals approximately 8 percent of the original value of the rebate vouchers held by consumers.
