Hazardous Waste/Solid Waste/CERCLA Litigation Unit

The Hazardous Waste/Solid Waste/CERCLA Litigation Unit serves two distinct clients.  On the enforcement side, the Unit represents the Hazardous Materials & Waste Management Division of the Colorado Department of Public Health & Environment.  We provide transactional, rule-making, administrative enforcement and litigation support for the enforcement of Colorado’s Hazardous Waste Act and Solid Waste Act, and represent the Division on a variety of environmental remediation matters, including Superfund cleanups.

The Unit also represents Colorado’s Natural Resources Trustees: The Attorney General, the Director of the Colorado Department of Public Health and Environment, and the Director of the Department of Natural Resources.  We investigate possible injuries to natural resources at hazardous substance release sites, assess damages, and conduct negotiations and if needed litigation to collect natural resources damages for the Trustees and the State.
