The State of Colorado and responsible parties have reached settlements regarding the State’s claim for natural resource damages resulting from releases of hazardous substances at the Lowry Landfill Superfund Site. The proposed Consent Decrees were lodged with the U.S. District Court on June 3, 2010.
The Consent Decree for Generator Defendants specifies that Molson Coors Brewing Company, Roche Colorado Corporation, The S.W. Shattuck Chemical Company, Inc., ConocoPhillips Company, The Gates Corporation, Alumet Partnership, Shell Oil Company, Hazen Research, Inc., Cyprus Amax Minerals Company, Metro Wastewater Reclamation District, Colorado, City of Littleton, Colorado, City of Englewood, Colorado, and City of Lakewood, Colorado will pay the State $1,029,702, for use to restore, replace or acquire the equivalent of the groundwater, a natural resource, injured by releases of hazardous substances at or from the site, and $77,228 for the State’s assessment costs.
The Performing Parties Consent Decree specifies that The City and County of Denver, Waste Management of Colorado, Inc., and Chemical Waste Management, Inc. will pay the State $500,000, to be used to establish or supplement an existing revolving loan fund or funds that will provide no- or low-interest loans to households with a demonstrated financial need for the repair of private residential sanitary sewer failures, for the purpose of improving water quality in the South Platte River watershed.
The proposed Consent Decrees will be available for 30 days for public comment. The State will accept comments through Sunday, July 6, 2010. The State will consider these comments before asking the Court to approve the Consent Decrees. The Consent Decrees are available on the Web sites of the Colorado Attorney General, the Department of Public Health and Environment and the Department of Natural Resources.
