Attorney General Suthers Obtains Indictment And Arrest Of Denver Man And Accomplices In Financial Fraud Scheme -- 11/22/2005

DENVER – Attorney General John Suthers today announced the indictment and arrests of Denver resident Raymond P. Morris (DOB 6/17/57), Janet L. Morris (DOB 3/26/56) and Gregory C. Erpelding (DOB 5/15/54) for defrauding investors in real estate and foreign currency trading schemes.

“These defendants are accused of defrauding Coloradans out of millions of their hard earned dollars,” said Suthers. “This indictment sends a message to would-be criminals that we will not tolerate fraudulent investment schemes.”

Attorney General Suthers Announces Antitrust Lawsuit Against Manufacturers Of Oral Contraceptive Ovcon® -- 11/07/2005

DENVER – Attorney General John Suthers announced today the filing of a civil law enforcement action against drug companies Warner Chilcott Corporation and Barr Pharmaceuticals. The lawsuit, joined by twenty-one other states, including the District of Columbia, charges both companies with antitrust violations that have prevented generic versions of Ovcon, a prescription oral contraceptive, from reaching the marketplace.

Attorney General Suthers Announces Arrest Warrant Issued For Las Animas Man Charged With Illegally Dumping Raw Sewage Near River -- 11/04/2005

DENVER – Attorney General John Suthers today announced an arrest warrant has been issued for Thomas Alex Rivera, DOB 8/26/47, for allegedly dumping raw sewage onto his property within close proximity to the Purgatoire River. Rivera is charged with class 4 felony theft, class 5 felony forgery and associated environmental crimes including criminal pollution and violation of the Solid Waste Act.

DENVER – With the enrollment period for Medicare Part D fast approaching this November 15, Colorado Attorney General John Suthers and AARP ElderWatch today warned Medicaid Part D consumers about avoiding fraudulent enrollment offers.

“The new drug benefit is the biggest change in the Medicare program since its creation forty years ago,” said Suthers. “As the enrollment date approaches, seniors should watch out for scams and be cautious about any offer to enroll them in Medicare Part D.”

Attorney General Suthers Successfully Defends TABOR Refund Provision Before United States Supreme Court -- 11/01/2005

DENVER – Yesterday, the U.S. Supreme Court denied certiorari in the case, Thorpe, et al. v. State of Colorado, et al., No. 04-1541, without opinion. In doing so, the Court let stand a ruling by the Colorado Court of Appeals allowing the General Assembly to refund TABOR surplus only to those who filed full-year income tax returns.

“This decision upholds the intent of the General Assembly that TABOR refunds should go only to those taxpayers who live and work in Colorado year-round,” said Attorney General Suthers.

Colorado Supreme Court Denies Cert In Colorado Criminal Justice Reform Coalition V. Joe Ortiz Et. Al. -- 10/17/2005

DENVER – The Colorado Supreme Court announced today, in an en banc decision, to deny certiorari in Colorado Criminal Justice Reform Coalition vs. Joe Ortiz et. al., 05 SC 370, allowing the Colorado Court of Appeals decision to stand, which upheld the constitutionality of HB 03-1256.
