Attorney General Suthers Completes Review Of Exempla Transfer

DENVER – Colorado Attorney General John W. Suthers today released his findings in a statutorily required review of a proposed transfer of Exempla Healthcare System assets from the Community First Foundation to the Sisters of Charity of Leavenworth Health System, Inc. In his review, the Attorney General found no material change in the charitable purposes of the transferred assets, and therefore no basis to challenge the transfer.

“The General Assembly mandated that a single, narrow standard of review should apply in non-profit to non-profit hospital transfers,” commented the Attorney General. “I recognize the strong emotional and political concerns surrounding this transfer, but per the statute, those concerns cannot alter the legal standard of review.”

The Attorney General’s decision allows the transfer to proceed without further review by the Department of Law. Pending litigation concerning the transfer will be determined by the courts, independent of the Attorney General’s review.
