Attorney General John Suthers Lauds Decision In Mill Levy Case

DENVER – Colorado Attorney General John W. Suthers applauded a decision released today by Judge Christina M. Habas in Mesa County Board of County Commissioners, et al. v. Colo. Dept. of Education and the State of Colorado and Governor Bill Ritter, Jr.  Judge Habas declared SB 07-199 an unconstitutional change in tax policy without proper voter approval. 

Attorney General John Suthers took the position in 2007 that SB 07-199 is unconstitutional and communicated that opinion to both Governor Ritter and the General Assembly.  “Judge Habas rightly vindicated the rights of Coloradans to vote on all property tax increases before they are instituted.  I look forward to the Colorado Supreme Court affirming this decision,” commented Attorney General Suthers. “This decision is a major victory for Colorado citizens.”
