DENVER—The Colorado Supreme Court today issued its opinion in the case Justus v. State. At issue was whether the Colorado Legislature could alter the cost-of-living (COLA) formula for PERA retirees. The Court reversed the Appellate Court’s finding and ruled that the legislature’s 2010 modification to the COLA formula was constitutional. The Colorado Attorney General’s Office represented The State of Colorado and Governor John Hickenlooper in this matter.

AT&T Mobility to Pay $105 Million in for ‘Cramming’ Customers’ Bills

DENVER—Colorado Attorney General John W. Suthers announced today a settlement with AT&T Mobility LLC to resolve allegations that AT&T Mobility placed unauthorized charges for third-party services on consumers’ mobile telephone bills, a practice known as “cramming.” Consumers who were crammed often complain about recurring monthly charges for premium text message subscription services (e.g. horoscopes, trivia, and sports scores) that they never requested.

DENVER—For defrauding investors of more than $750,000 in an oil and gas wells securities scheme, Robert Allen Zickefoose (D.O.B. 07/19/64) will serve a 10-year prison sentence. He was initially indicted by the Colorado Attorney General’s Office in July of 2013 and plead guilty in July 2014. Zickefoose failed to appear for his hearing last month and subsequently, an El Paso County judge issued the sentencing order.

DENVER—This morning, the Colorado Supreme Court removed the legal obstacles preventing Colorado’s county clerks from issuing marriage licenses to same-sex couples.

Same-Sex Marriage will be the Law in Colorado when the 10th Circuit Court and Lower Courts Lift Stay Orders

DENVER—The United States Supreme Court this morning denied review of all seven of the petitions from the lower Federal Circuit Courts that arose from challenges to state bans on same-sex marriage. Because the 10th Circuit Court, which has jurisdiction over Colorado, struck down Utah and Oklahoma’s ban, today’s decision by the high court clears the way for same-sex couples to legally wed in Colorado once stay orders have been lifted. Governor John Hickenlooper and Clerks of Adams, Boulder, Denver and Jefferson Counties Sign on to Motions

DENVER—This afternoon, the Colorado Attorney General’s Office, the Governor’s Office and the Clerks of Adams, Boulder, Denver and Jefferson Counties filed joint motions to lift stays in the 10th Circuit and Colorado Supreme Court. In addition, the parties moved to dismiss appeals of lower-court decisions in federal court as well as in Adams and Boulder Counties.  While the high court’s decision not to hear an appeal of the 10th Circuit ruling means that same-sex marriage will be legal in Colorado soon, stays put in place by the federal and state courts must first be lifted.

Bogus Coupon Scheme Triggered Consumer Complaints Resulting in Lawsuit

DENVER—Colorado Attorney General John Suthers announced today that a Denver District Court Judge has permanently barred Andre Shatyko (D.O.B. 01/01/86) and Alexander Kurdyukov (D.O.B. 04/18/87), and their companies, Seabreeze Air, LLC; Seabreeze Air; Quality Air; Quality Air “LLC”; and Fresh Air, LLC from advertising or performing air-duct cleaning services in Colorado. Using Groupon, LivingSocial and ValPak, Seabreeze offered services at low prices with no intention of honoring the advertised rate.
