DENVER—Today Boulder County District Court Judge Andrew Hartman denied the state’s motion for a temporary restraining order and preliminary injunction against Boulder County Clerk and Recorder Hillary Hall for issuing marriage licenses to same-sex couples. DENVER—In a summary judgment order issued today in Adams County District Court, Judge C. Scott Crabtree found Colorado’s Constitutional ban on same-sex marriage violates the United States Constitution. However, like the 10th Circuit Court, the judge also stayed his ruling pending appeal finding that “a stay is necessary to avoid the instability and uncertainty which would result in the state of Colorado if the Court did not stay its ruling and for the orderly administration of justice.”

DENVER—Colorado Attorney General John Suthers announced that Tri State Environmental Group and Aftermath Cleanup & Remediation Services, LLC, will pay fines totaling $1 million for failing to properly dispose of asbestos containing waste material (ACWM). DENVER—Colorado Attorney General John Suthers filed a motion today with the Boulder County District Court seeking to stop the Boulder County Clerk and Recorder from issuing invalid same-sex marriage licenses while current Colorado law remains in effect. This action comes after attempts over the past several days to resolve this issue directly with the Boulder County Attorney and Clerk and Recorder were rejected.

DENVER—In an effort to quickly bring legal clarity to same-sex marriage issues in Colorado, this afternoon the Colorado Attorney General’s Office filed a motion with the support of the governor’s office and the Denver and Jefferson County clerks that would effectively suspend contentious litigation while higher courts consider the question. The motion acknowledges that the 10th Circuit Court of Appeals’ recent decision overturning laws similar to Colorado’s will apply to Colorado’s laws as well, if and when it becomes final.

DENVER – Today, U.S. District Court Judge Marcia S. Krieger has issued an order in the case known as Colorado Outfitters Association et al v. Hickenlooper, finding that gun laws passed by the Colorado General Assembly in 2013 are constitutional. Judge Krieger found that the ban on “large capacity magazines” exceeding 15 rounds and expanding mandatory background checks to recipients of firearms in some private transfers does not violate the Second Amendment to the U.S. Constitution.

DENVER – Today, the 10th Circuit Court of Appeals issued a 2-1 ruling finding Utah's ban on same-sex marriage to be in violation of the United States Constitution's guarantees of equal protection and due process. The 10th Circuit itself delayed the effect of its order pending resolution of the case by the United States Supreme Court. Subsequent to that decision, the Boulder County Clerk and Recorder announced Wednesday afternoon that the office would begin issuing same-sex marriage licenses.  

DENVER—Colorado Attorney General John Suthers today announced a $550 million nationwide state-federal settlement with mortgage lender and servicer SunTrust Mortgage Inc. to remedy mortgage origination, servicing, and foreclosure abuses. To resolve past SunTrust abuses, some Colorado borrowers are now eligible for $4,448,533 in principal reduction loan modifications, refinancing for underwater mortgages, foreclosure payments and other relief.

DENVER —Colorado Attorney General John Suthers banded with 44 other state attorneys general today to announce a $105 million consumer protection settlement with GlaxoSmithKline, LLC (NYSE: GSK) to resolve allegations that the company unlawfully promoted its asthma drug, Advair®, and antidepressant drugs, Paxil® and Wellbutrin®.
