Bogus Coupon Scheme Triggered Consumer Complaints Resulting in Lawsuit

DENVER—Colorado Attorney General John Suthers announced today that a Denver District Court Judge has permanently barred Andre Shatyko (D.O.B. 01/01/86) and Alexander Kurdyukov (D.O.B. 04/18/87), and their companies, Seabreeze Air, LLC; Seabreeze Air; Quality Air; Quality Air “LLC”; and Fresh Air, LLC from advertising or performing air-duct cleaning services in Colorado. Using Groupon, LivingSocial and ValPak, Seabreeze offered services at low prices with no intention of honoring the advertised rate.

Total Funding for Rocky Mountain Greenway Project Now $82.55 Million

DENVER—The Colorado Natural Resources Damages Trustees today awarded $17.4 million in funding for 10 conservation projects in the Rocky Mountain Arsenal National Wildlife Refuge area. This money is in addition to a prior award of $10.15 million that 11 projects received in July 2012 and raises the total natural resources damages funding directed towards conserving and restoring the region to $27.55 million.

DENVER—The Colorado Attorney General’s Office announced that the statewide grand jury has issued a 37-count indictment against six family members for using their status in the real estate industry to perpetrate a fraud-for-profit mortgage fraud scheme. The family is accused of manipulating “straw buyers” to buy and sell properties destined for foreclosure.

17 People Indicted for Trafficking Methamphetamine

DENVER—The Colorado Attorney General’s Office announced one of the largest single incidents of  methamphetamine seizure by law enforcement in state history in partnership with the U.S.

DENVER—Colorado Attorney General John Suthers today announced that Sang Leaming owner of Tobacco King will pay $100,000 for selling “spice” products that contained synthetic cannabinoids and which are illegal under Colorado law. Tobacco King sold products that were deceptively labeled and failed to disclose that they were illegal as well as harmful. The terms of the Consent Judgment impose the nation’s largest-ever civil fine for selling Spice products against a single store.

DENVER—Denver District Court Judge Robert McGahey ordered Sea to Ski Vacations and its owners Andrew Wunder, Bethany Wunder, Christian Wunder, and Stephen Wunder, (a/k/a Mark Dutell, Stephen Andrews, Michael Miller, Andrew Stephens, and Bethany Gonsowski), to pay more than $7.0 million in penalties and restitution to consumers for violations of the Colorado Consumer Protection Act. Additionally, Judge McGahey prohibited the Wunders from owning, managing, or operating travel-related businesses again because of their deceptive business practices. 

DENVER—Colorado Attorney General John Suthers today announced that after being convicted of two counts of securities fraud, Jeffory Shields (D.O.B. 10/01/1964) was sentenced to serve an eight-year prison sentence and pay $5,659,088 in restitution.

42 State Attorneys General Allege Pfizer’s Off-Label Marketing Violated FDA Warning

DENVER —The Colorado Attorney General’s Office joined 41 other state attorneys general today in announcing a consumer protection settlement with Pfizer, Inc., parent company of Wyeth Pharmaceuticals, Inc. totaling $35 million of which Colorado will receive $649,029.

DENVER—Colorado Attorney General John W. Suthers announced today that his office has issued an opinion under the Hospital Transfer Act (C.R.S § 6-19-101, et seq.) relating to the proposed transaction between the Sisters of Charity of Leavenworth Health System Inc. (d/b/a SCL Health), Saint Joseph Hospital Inc., and National Jewish Health. This matter was noticed on July 10, 2014.

DENVER—In response to today’s Colorado Supreme Court ruling regarding the issuing of same-sex marriage licenses, Colorado Attorney General John Suthers issued the following comment.

“Today, the Colorado Supreme Court restored order to the state’s legal process by making it clear that all clerk and recorders should comply with existing state law. We are pleased that the focus may now return to the important constitutional issues posed by the same-sex marriage cases pending in Colorado and around the country.”
