DENVER – Attorney General John Suthers announced today that his office filed a petition asking the Colorado Supreme Court to reconsider its’ decision denying Initiative #55, aimed at services provided to illegal immigrants, a place on the November ballot.
The petition requests a rehearing for the following reasons: 1) the Court relied on arguments and evidence improperly presented for the first time in the Petitioner’s Reply Brief, 2) the decision conflicts with well-established principles regarding the single subject doctrine, therefore leaving the Title Board with inconsistent guidance and, 3) the Court erroneously applied a single subject analysis to perceived errors in the title of the measure.
The Attorney General’s Office filed their petition in advance of the fourteen day deadline. The proponents of the measure have until June 26 to submit their petition. After their submission, the Colorado Supreme Court will make its’ determination. The Colorado Supreme Court does not have a deadline by which their response must be issued.
